1 Introduction

1. These terms and conditions (together with the documents referred to in it) (Terms) tell you the Terms under which Wren Kitchens Limited (we), supply information on our website (www.wrenkitchens.com and all associated pages (the Site)) and how you may use the Site.

2. These terms and conditions refer to the following additional terms, which also apply to your use of our site:

   1. Our Security and Privacy Policy, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using the Site, you consent to such processing and you warrant that all data provided by you is accurate;

   2. Our Acceptable Use Policy, which sets out the permitted uses and prohibited uses of the Site. When using the Site, you must comply with this Acceptable Use Policy;

   3. Our Cookie Policy, which sets out information about the cookies on the Site; and

3. You should read these Terms carefully before using the Site.

4. By accessing or using this Site or otherwise indicating your consent, you agree to be bound by these Terms.

The Site is operated by Wren Kitchens Limited. We are registered in England and Wales under company number 06799478 and with our registered office at The Nest, Falkland Way, Barton-upon-Humber, DN18 5RL. Our main trading address is The Nest, Falkland Way, Barton-upon-Humber, DN18 5RL. Our VAT number is 977 7696 30.

3 Using the Site

1. The Site is for your personal and non-commercial use only.

2. You agree that you are solely responsible for:

   1. all costs and expenses you may incur in relation to your use of the Site; and

   2. keeping any passwords and account details confidential.

3. The Site is intended for use only by those who can access it from within the UK. We may accept orders for delivery to locations outside of the UK although this may depend on certain customs, legal and other practical restrictions. If you choose to access the Site from locations outside the UK or place orders for delivery to locations outside the UK, you are responsible for compliance with local laws where they are applicable

4. We seek to make the Site as accessible as possible. Please see our accessibility statement here.

5. We may prevent or suspend your access to the Site if you do not comply with any part of these terms and conditions, any terms or policies to which they refer or any applicable law.

6. We take all reasonable steps to ensure the Site is available 24 hours every day, 365 days per year. However if the Site is unavailable at any time, for any reason, we shall not be held liable in any way.

4 Intellectual Property and Copyright

1. You are only permitted to use the Site for your own purposes and you can download and print material from this Site provided you do not modify any content without consent. You agree not to adjust to try to circumvent or delete any notices contained on the Site (including any intellectual property notices) and in particular in any digital rights or other security technology embedded or contained within the Site.

2. The copyright and other intellectual property rights in all material on this Site are owned by us or our licensors and must not be reproduced without our prior consent.

3. No part of the Site may be reproduced without our prior written consent.

5 Data Protection

1. Except as expressly set out in these Terms, all use of your personal information will be made in accordance with our privacy policy

2. By registering any of your personal details with us, you are agreeing to allow us to contact you regarding any of our own products or services. Very occasionally, we may share your details with carefully selected third parties. However, if your communication preferences show that you have chosen not to receive information from third parties, then of course your details will not be shared.

6 Accuracy of information and availability of the Site

1. While we try to make sure that the Site is accurate, up-to-date and free from bugs, we cannot promise that it will be at all times. Furthermore, we cannot promise that the Site will be fit or suitable for any purpose. Any reliance that you may place on the information on this Site is at your own risk.

2. We have taken care to describe and show products as accurately as possible on our site. Despite this, slight variations in products may occur for example colours and textures may appear differently on photographs on our site than they look in reality and colours may also vary between different batches of production. If you are in doubt please visit one of our showrooms which can be found using the link on the Site or contact us.

3. We may update our Site from time to time, and may change the content at any time. However, please note that any of the content on our Site may be out of date at any given time, and we are under no obligation to update it.

4. We do not guarantee that our Site, or any content on it, will be free from errors or omissions.

7 Hyperlinks and third party sites

The Site may contain hyperlinks or references to third party websites other than the Site. Any such hyperlinks or references are provided for your convenience only. We have no control over third party websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink and reference to any third party website does not mean that we endorse that third party's website, products or services. Your use of a third party site may be governed by the terms and conditions of that third party site.

8 Limitation on our liability

1. Except for:

   1. death or personal injury caused by our negligent acts or omissions (or those of any of our employees or agents);

   2. fraud or fraudulent misrepresentation; or

   3. breach of any of the provisions implied into these terms and conditions under the Sale of Goods Act 1979 (or any other law),

   we will only be liable for any loss or damage that is a reasonably foreseeable consequence of a breach of these Terms. Losses are foreseeable where they could be contemplated by you and us at the time these Terms are entered into. We are not responsible for indirect losses that happen as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of profits or loss of opportunity).

9 Events beyond our control

We shall have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control including, without limitation, any act, event, non-occurrence, omission or accident beyond our reasonable control and includes, in particular (without limitation), failure of energy sources or transport network, acts of God, war, terrorism, riot, civil commotion, interference by civil or military authorities, national or international calamity, armed conflict, malicious damage, breakdown of plant or machinery, nuclear, chemical or biological contamination, sonic boom, explosions, collapse of building structures, fires, floods, storms, earthquakes, loss at sea, epidemics or similar events, natural disasters or extreme adverse weather conditions, or default of suppliers or subcontractors.

10 Viruses

1. We do not guarantee that our Site will be secure or free from bugs or viruses.

2. You are responsible for configuring your information technology, computer programmes and platform in order to access our Site. You should use your own virus protection software.

3. You must not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

11 Rights of third parties

No one other than a party to these Terms has any right to enforce any of these Terms.

12 Variation

These Terms are dated 29th Apr 2017. No changes to these Terms are valid or have any effect unless agreed by us in writing. We reserve the right to vary these Terms from time to time. Our new terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms from time to time to verify such variations.

13 Severability

If any of these Terms or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

14 Law and jurisdiction

Any dispute or claim arising out of or in connection with this policy's subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such policy or their formation (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15 Appliance Price Match

1. Wren Kitchens price-match appliances only from the following retailers; AO.com, Appliance Direct, Euronics, Argos, B&Q, Currys, John Lewis, Magnet and Wickes.

2. The appliance(s) being matched must be exactly the same product.

3. The appliance(s) being matched must be in stock and available to order online.

4. The appliance(s) being price-matched must be available for UK mainland delivery.

5. The appliance(s) being price-matched must be available to deliver to your postcode from the retailer.

6. The price being matched includes all delivery costs and surcharges.

7. The appliance(s) being price-matched must be brand new.

8. The price being matched must be a genuine price and not an error.

9. Offer applies when you buy 5 units or more.

10. The price match is subject to availability and only applies whilst stocks last.

11. The price being matched must be the individual appliance price on the retailer’s website and does not include any related extra discount (e.g. 50% off Appliances when you buy a kitchen)

16 #wrenovation Competition

1. For your chance to win up to £750 upload your photos of your finished kitchen or bedroom to Submit your #wrenovation | Wren Kitchens

   1. To enter this competition you must be:

      1. Wren Kitchens customer with a verified order.

      2. 18 years old or over at the time of entry.

   2. The prize draw runs on a monthly basis.

   3. All winners will be contacted within the 1st week of each month.

   4. If you win a competition, we will notify you by telephone or e-mail. If we cannot contact you or you do not respond within two weeks, we reserve the right to offer the prize to another competition entrant.

   5. The prize for the winner is £750 paid by cheque. Payment will only be made if a video case study is agreed.

   6. You must be a customer of Wren Kitchens and the kitchen/bedroom photographed must be the Wren Kitchens kitchen/bedroom purchased.

   7. By sharing your details and photographs, you are giving Wren Kitchens permission to publish it on their website and in any form of marketing activity.

   8. You are giving Wren Kitchens permission to share your Wrenovation story and photographs with an unlimited amount of external media outlets.

   9. To enter via instagram you must follow the wrenkitchens account and put '#wrenovation' in your post.

   10. Only one entry can be made per customer. All duplicate submissions will be ignored.

   11. Wren Kitchens reserves the right to extend the timeframe or withdraw the prize draw at any point.

   12. Competitions are not open to employees (or members of their immediate families) of Wren Kitchens.

   13. Wren Kitchens reserves the right to decline publication of any photograph and description where it is considered unsuitable.

   14. You may only submit your photograph and description to one monthly prize draw. Any additional entries will be ignored.

   15. Incorrectly completed entries will be ignored.

   16. Please read our Privacy Policy which tells you how we use any personal information we may collect about you by entering a competition.

   17. No responsibility can be accepted for entries that are not received for any reason.

   18. This prize draw is run by Wren Kitchens Limited, The Nest, Falkland Way, Barton-upon-Humber, DN18 5RL.

   19. By entering the competition you agree for Wren to use the information submitted on its website and social media.

   20. By entering the competition you agree for Wren to display your kitchen or bedroom specification for the purpose of users to explore the objects chosen in your kitchen/bedroom.

   21. By entering the competition you waive and release any rights of privacy and publicity in connection with the use of your name, picture, video, chosen kitchen or bedroom style, colour and pricing information.

17 NPS Invitations

1. The Wren Kitchens Customer Satisfaction Survey Prize Draw (the “competition”) is open to residents of the UK aged 18 and over.

2. The Competition is not open to employees of Wren Kitchens, their group companies or family members, nor anyone else connected to the Competition.

3. To be eligible for the prize draw, you must complete and submit any of the customer satisfaction surveys issued by Wren Kitchens between 00:01 on Saturday 1st October and 23:59 on Saturday 31st December 2022.

4. Entries must include all details requested in the survey. Entries that do not comply with these promotion rules will be void and will not be entered into this promotion.

5. Each individual survey completed is equivalent to one entry, with the opportunity to submit up to 7 entries.

6. There is one prize to be won - £250 Amazon.co.uk Gift Card

7. A winner will be drawn at random from all the completed and submitted surveys using a random number generator, within 7 days of the competition closing.

8. The winner will be contacted by email within 7 days of the competition closing.

9. If the selected winner does not respond within 7 days of being notified, then the winner's prize will be forfeited, and Wren Kitchens shall be entitled to select another winner.

10. The surname and county of the winner will be published at www.wrenkitchens.com for 14 days after the closing date. If you do not wish for your surname and county to be announced as the winner of the competition referred to above, you must notify Wren Kitchens Ltd within a reasonable period of time after being notified as the winner.

11. The prize is subject to availability.

12. Wren Kitchens Ltd reserves the right to substitute the prize (£250 Amazon Gift Card) with one of equivalent or greater value if this is necessary for reasons beyond its control. No cash alternative will be offered for any prize.

13. Wren Kitchens Ltd reserves the right to withdraw or extend the time periods and notification dates for this prize draw at any time.

14. By entering the prize draw, you agree to be bound by these terms and conditions.

15. These terms and conditions shall be governed by and construed in accordance with the laws of England and any disputes shall be subject to the exclusive jurisdiction of the English courts.

16. While nothing in these terms and conditions will limit the liability of Wren Kitchens for death or personal injury caused by its negligence or for fraud, Wren Kitchens will not be legally responsible to entrants or winners for any losses that were not foreseeable to Wren Kitchens or to the entrant at the time of entry to the promotion or which are caused by a third party.

18 Property Value Survey

19 Recommend a Friend

1. This offer pays a recommender and discounts the recommended friend's order with the offer payments for each qualifying recommendation made.

2. We may change, extend or withdraw this offer at any time and without letting you know.

3. To qualify for this offer the recommender must:

   1. Have a personal Wren Kitchens account.

   2. Have a Wren Kitchens order delivered.

4. Providing the above requirements are met, the referee must:

   1. Not have a showroom appointment, home measure, order or quote that was created in the last 12 months.

   2. Must not have already been referred to us unless the referral was cancelled.

   3. Have a personal account i.e. trade customers are excluded from this promotion.

5. Both parties must have a minimum order value of £5,000.

6. When a friend makes a qualifying purchase, both referrer and friend will each receive £200 reward.

   1. The referrer will be sent a cheque within 30 days of their friend's completed kitchen order. This is defined by an order that has been invoiced and delivered in full.

   2. The referee will have their reward deducted from the total purchase value of their kitchen.

7. There's no limit to the number of friends a recommender can recommend and each recommended friend will qualify for a reward if they meet the conditions.

8. Where a referee does not have an existing account we will not store their personal details until an invitation is accepted.

9. Invitations remain active for 90 days. In the event that the invitation is neither accepted or declined during this period then it will expire.

10. The recommendation will become invalid in the event that a referee creates an account without accepting their friends recommendation and goes on to make an order.

11. If a referee has an existing account the recommendation is automatically accepted. The referee can then choose to cancel the invitation by logging in to their account.

12. This offer applies to the first lead created after a referral has been accepted.

20 Freebie Friday Competition

1. The Wren Kitchens Freebie Friday Prize Draw (the “competition”) is open to residents of the UK aged 18 and over.

2. The Competition is not open to employees of Wren Kitchens, their group companies or family members, nor anyone else connected to the Competition.

3. To be eligible for the prize draw, you must complete the following actions for the channel on which you are entering:

   1. Facebook – Like, share, comment and be following Wren Kitchens on Facebook

   A maximum of 3 (three) entries per person. Incomplete, illegible, misdirected or late entries will not be accepted.

   Entries that do not comply with these promotion rules will be void and will not be entered into this promotion.

   Wren Kitchens reserves the right to discount any irrelevant, inappropriate or offensive entries, at its sole discretion.
